Applications for a permit to carry a hand gun can be made through the secretary of the state police
The applicant must be 18 years old
Have not been convicted of a felony or crime punishable by imprisonment
Has not been committed within the previous ten years to any juvenile detention center for longer than one year
Has not based on the results of investigation, exhibited a propensity for violence or instability
Is not an addict or an alcoholic nor has ever been convicted of a narcotics offence
Has based on the results of an investigation “Good and substantial reason” to carry a hand gun, including finding that the permit is “necessary as a reasonable precaution against apprehended danger”
Secretary may charge $70 non-refundable upon beginning the application process
$50 renewal fee
$5 fingerprint fee
Permit is valid for 2 years
Permit expires on last day of holders birth month
Permit holder must carry permit at all times that they have the weapon on their person
Unlawful for a person to carry under the influence of drugs or alcohol
Out of state permits are not honored
Antique fire arms (manufactured before 1898) are exempt
If a person has spent more than 30 consecutive days in any institution for treatment of a mental disorder must provide a physicians certificate certifying that he is capable of possessing a hand gun.
Most Maryland dealers who are licensed by the state police routinely await the approval even after the required 7 days.
An enclosed holster is any holster with a flap or strap to secure the handgun
Rifles and shot guns being transported in a vehicle must be unloaded
It is a crime to wear or carry openly any rifle or shotgun with the intent or purpose of unlawfully injuring any person
It is unlawful for any person without any permit to wear or carry a handgun, openly or concealed.
It is unlawful to knowingly transport a handgun in any vehicle traveling on public roads, highways, waterways or airways
Federal, and Maryland state or local law enforcement officers generally are exempt
Sheriffs and their deputies are exempted only while on active assignment engaged in law enforcement and only with the respect to handguns which they are duly authorized to wear, carry, or transport as part of their official equipment
Law enforcement officers from other states are exempt only while on official assignment
No violation is committed by any person who can demonstrate that the handgun is being carried, worn or transported
Too or from a place of legal purchase or sale/repair shop
Between such persons bona fide residence or between his residence and place of business
While engaged in or traveling to and from a target shoot
By a bona fide gun collector who is moving any part or all of his gun collection from place to place for exhibition whether it be private or public
No permit is required to possess a rifle or shotgun
Possession of a handgun is prohibited by any person who:
Has been convicted of a crime of violence
Has been convicted of a violation of the Maryland Pistol Law
Is a fugitive from justice
Is a habitual drunkard
Is an addict or habitual user of narcotics
Suffers from a mental disorder and has a history of violent behavior
It is unlawful to possess, sell, offer to sell, transfer, or receive a so-called “Assault pistol”
After June 1, 1994, It is unlawful to sell, offer to sell, or transfer, or receive any firearm magazine (except a tube magazine for a .22) that will hold more than 20 rounds.0
